1. Scope of Application

These Terms of Use ("Terms") govern your use of the Mindova mobile application ("App"), a life-coaching tool with AI assistance developed and operated by:

2. Service Description

Mindova is a life-coaching tool with AI assistance. It is:

• NOT medical treatment or therapy
• NOT a replacement for professional mental health services
• A conversational AI coaching assistant for personal development and goal setting

3. AI Data Processing

Your conversation data is transmitted to third-party AI services for processing:

• OpenAI (USA) - Natural language processing and conversation generation
• Simli (USA/EU) - Avatar video generation
• LiveKit (worldwide) - Real-time voice and video communication

By using the App, you consent to this data transmission. For details, see our Privacy Policy.

4. User Accounts

You can use Mindova:

• Anonymously - All data stored locally on your device only
• With registration - Data synchronized to cloud for backup and multi-device access

Age Requirement: Users must be 16 years or older.

5. Subscription and Payments

Mindova offers auto-renewable subscriptions:

• Weekly Package: 3 sessions (30 min each) for €9.99, valid for 7 days
• Monthly Package: 10 sessions (30 min each) for €29.99, valid for 30 days

Payment processing: All payments are processed through Apple App Store or Google Play Store.

Cancellation: You can cancel your subscription at any time through your App Store account settings. Unused sessions expire at the end of the subscription period.

Refunds: Refunds are handled according to App Store/Play Store policies.

By purchasing a subscription, you agree to these Terms of Use and our Privacy Policy.

6. Automated Decision-Making (GDPR Art. 22)

The App uses automated analysis of your conversations for:

• Therapeutic pattern recognition
• Personality profiling (Big Five assessment)
• Real-time crisis detection (safety feature)

Your Rights:

• Request explanation of automated analyses
• Request manual review instead of automation
• Object to automated processing (note: may reduce app functionality)

7. Withdrawal of Consent

You can withdraw your consent to data processing at any time. Consequences:

• Coaching features may be impaired or unavailable
• Already processed data remains valid under previous legal basis
• New data processing stops immediately

8. Liability Disclaimer

Mindova is NOT a substitute for professional therapy or medical advice.

We assume no liability for:

• Coaching results or outcomes
• Technical disruptions or service interruptions
• Failed crisis detection (automated systems are not 100% reliable)
• Decisions made based on app recommendations

In case of emergency or crisis: Contact emergency services (112 in EU, 911 in US) or a crisis helpline immediately.

9. Crisis Detection and Safety

The App includes automatic monitoring for signs of crisis or self-harm in conversations. When detected:

• Sessions are automatically interrupted
• Professional help resources are provided
• Crisis sessions are NOT stored in your coaching records
• Crisis sessions do NOT count toward your session limits

Important: This safety feature does NOT replace professional help and cannot be 100% reliable.

10. Account Deletion

You can delete your account at any time through the app settings.

• Local data is deleted immediately
• Cloud data is deleted within 30 days
• Some data may be retained for legal obligations (e.g., payment records)

11. Usage Rights

You receive a personal, non-exclusive, non-transferable right to use the App. You may NOT:

• Reverse engineer, decompile, or disassemble the App
• Use the App for commercial purposes
• Share your account with others
• Attempt to circumvent security measures

12. Changes to Terms

We may update these Terms to reflect new features, legal requirements, or operational changes. Significant updates will be communicated with at least 30 days advance notice via in-app notification. Continued use after notification constitutes acceptance of changes.

13. Applicable Law and Jurisdiction

Applicable Law: German law applies.

Jurisdiction: Stuttgart, Germany.
